These Terms of Service govern the use of Claimpaign, a Proof of Onboarding as a Service platform for token claim campaigns on the Cardano blockchain, operated by Tommy Kammerer, Raiffeisenstr. 30, 77743 Neuried, Germany.

1. Scope
These terms apply exclusively to business relationships with entrepreneurs and business entities. Consumers within the meaning of § 13 BGB (German Civil Code) are excluded from using this service.
2. Subject Matter
Claimpaign provides a SaaS platform for Proof of Onboarding campaigns: QR code-based token claim campaigns on the Cardano blockchain. Organizations create campaigns, generate claim codes, and distribute them. Recipients scan codes with compatible wallets to receive tokens on-chain.
3. Contract Formation
The contract is formed upon registration, confirmation of business customer status, and activation of a paid plan or campaign.
4. Scope of Services & SLA
Description of included services. Availability is provided on a commercially reasonable efforts basis without guaranteed SLA. Blockchain transactions are subject to network conditions beyond our control.
5. Pricing & Payment
Pay-per-redemption model. Billing via Stripe. Pursuant to § 19 UStG (German Small Business Regulation), no VAT is charged. Price changes with reasonable advance notice.
6. Term & Termination
Contract term, notice periods, right to extraordinary termination for cause.
7. Limitation of Liability
Liability is limited to intent and gross negligence. No liability for lost profits. Liability cap equal to fees paid in the preceding 12 months. No liability for blockchain network outages or smart contract risks.
8. Warranty
Warranty period is limited to 12 months (permissible in B2B contracts under German law).
9. Data Protection
Reference to separate Privacy Policy. Note regarding data processing agreements (DPA) with sub-processors (Cloudflare, Stripe, etc.).
10. Confidentiality
Both parties agree to treat business information as confidential.
11. Governing Law & Jurisdiction
German law applies. Exclusive jurisdiction is Offenburg, Germany (permissible in B2B contracts).
12. Final Provisions
Severability clause. Amendments require written form.
